Beste leden van het Bestuur,
Als (oud)- personeelsleden van Nederlandse universiteiten en hogescholen zijn wij allen (gewezen/gepensioneerde) deelnemers van het ABP. We willen ons ongenoegen uiten over ABPs investeringen in bedrijven die medeplichtig zijn aan de Israëlische bezetting en kolonisering van het Bezette Palestijns Gebied. Deze bezetting is op 19 juli jl door het Internationaal Gerechtshof illegaal verklaard.
Volgens de Don't Buy Into Occupation Country Brief December 2023, heeft ABP
"voor 2,8 miljard USD belegd in bedrijven die betrokken zijn bij de Israëlische nederzettingeneconomie. Het betreft onder meer beleggingen in Cisco Systems, Motorola, Caterpillar en Booking Holdings. Wel heeft ABP in 2020 besloten niet langer te investeren in twee banken die Israëlische nederzetttingen zouden financieren, Bank Hapoalim en Bank Leumi."
Volgens uw lijst Beursgenoteerde Beleggingen per 31 maart 2024, belegde ABP op die datum nog steeds in deze vier bedrijven. Over elk van deze bedrijven zullen we hieronder iets zeggen.
Wij willen uw aandacht in het bijzonder vestigen op onze zorgen over Caterpillar Inc. en Booking Holdings.
Het Israëlische leger heeft decennialang Caterpillar D9-bulldozers, uitgerust met bepantsering en wapens, omgebouwd voor gebruik bij het slopen van huizen en infrastructuur in het bezette gebied, maar ook in gevechtssituaties. Vanaf de dood van de Amerikaanse vredesactiviste Rachel Corrie in 2003 tot de nog altijd voortdurende Israëlische aanval op Gaza, zijn Caterpillar-bulldozers betrokken geweest bij mensenrechtenschendingen.
Bovendien is bekend dat er milieu- en bestuurskwesties rond Caterpillar bestaan: de CEO James Umpleby is tegelijk ook de voorzitter en er zijn zorgen over de lobbyactiviteiten van het bedrijf.
Het Noorse pensioenfonds KLP heeft besloten Caterpillar Inc. met ingang van juni 2024 uit te sluiten van zijn beleggingsportefeuilles.
Welke mogelijke reden kan ABP dan nog hebben om Caterpillar in zijn portefeuille te blijven houden?
We gaan nu over op Booking Holdings. Booking.com is een Nederlands dochterbedrijf hiervan. Meerdere NGO's hebben aangifte gedaan tegen Booking.com wegens witwassen van winsten uit Israëlische oorlogsmisdaden in Palestina. Het bedrijf faciliteert namelijk de verhuur van vakantiewoningen die zijn gebouwd op land dat is gestolen van de Palestijnse bevolking. Booking wordt in de bijgewerkte VN-database vermeld als een van de bedrijven die "diensten en nutsvoorzieningen leveren ter ondersteuning van het onderhoud en het bestaan van nederzettingen".
Amnesty International concludeert dat Booking.com, door de nederzettingstoerismeindustrie en bijgevolg de nederzettingeneconomie, te stimuleren, bijdraagt aan en profiteert van het onderhoud, de ontwikkeling en de uitbreiding van illegale nederzettingen.
En dan is er nog Cisco Systems. In 2018 is Cisco een langdurig partnerschap aangegaan met de Israëlische regering voor een grootschalig project dat gedeeltelijk wordt geïmplementeerd in bezette Palestijnse en Syrische gebieden.
Tenslotte willen we het over Motorola hebben. Motorola Solutions werkt samen met het Israëlische leger, het Ministerie van Defensie en met nederzettingenraden in het Bezette Palestijns Gebied. Motorola is een van de bedrijven die zijn opgenomen in de bijgewerkte VN-database (juni 2023), vanwege de levering van bewakings- en identificatieapparatuur voor nederzettingen, de scheidingsmuur en controleposten die rechtstreeks verband houden met nederzettingen; evenals de levering van beveiligingsdiensten, uitrusting en materialen aan ondernemingen die in nederzettingen actief zijn.
Andere Europese pensioenfondsen desinvesteren uit de bezetting. Naast de verschillende desinvesteringen door de Noorse fondsen heeft het Universities Superannuation Scheme (USS) in het VK de blootstelling aan Israëlische aandelen en schulden ‘aanzienlijk’ verminderd onder druk van de leden. Wij wijzen erop dat ABP al heeft gedesinvesteerd uit twee Israëlische banken, maar wij dringen er bij u op aan om die lijn verder door te trekken, conform uw Duurzaam en Verantwoord Beleggingsbeleid, en om te desinvesteren uit alle investeringen die bijdragen aan Israëls illegale bezetting en ernstige mensenrechtenschendingen.
Als u uit de hierboven genoemde bedrijven daadwerkelijk heeft gedesinvesteerd, zullen wij dat heel graag vernemen, en wij kijken ernaar uit om aankondigingen van uw besluit op uw website en in persberichten te lezen.
Wij zien uw reactie graag tegemoet. Dutch Scholars for Palestine zou graag in gesprek gaan met leden van het bestuur om deze kwesties diepgaander te bespreken.
Petitie voor ABP om te desinvesteren uit bedrijven die betrokken zijn bij de Israëlische bezetting en apartheid

Dear members of the Board,
As (former) employees of Dutch universities and universities of applied sciences, we are all active/deferred/retired members of ABP. We wish to express our dismay at ABP's investments in companies which are complicit in the Israeli occupation and colonisation of the Occupied Palestinian Territory. This occupation was declared to be illegal by the International Court of Justice on 19th July of this year.
According to the Don't Buy Into Occupation Country Brief December 2023,
"Algemeen Burgerlijk Pensioenfonds (ABP) has invested USD 2.8 billion in companies involved in the Israeli settlement economy. This includes investments in Cisco Systems, Motorola, Caterpillar and Booking Holdings. However, ABP decided in 2020 no longer to invest in two banks that allegedly finance Israeli settlements, Bank Hapoalim and Bank Leumi."
According to your list of Stock-Exchange Quoted Investments as of 31st March 2024, ABP was still investing in these four companies on that date. We will say something about each of them in turn.
In particular we would like to draw your attention to our concerns about Caterpillar Inc. and Booking Holdings.
Israel’s military has for decades converted Caterpillar D9 bulldozers, fitted with armour and weapons, for use in demolishing houses and infrastructure in the occupied territory, as well as in combat scenarios. From the death of US peace campaigner Rachel Corrie in 2003 to the ongoing Israeli assault on Gaza, Caterpillar bulldozers have been involved in human rights violations.
Moreover, there are known to be environmental and governance issues around Caterpillar: the CEO James Umpleby is simultaneously also the Chair, and there are concerns about the company's lobbying activities.
Norwegian pension company KLP has decided to exclude Caterpillar Inc. from its investment portfolios with effect from June 2024.
What possible reason can ABP have for continuing to include Caterpillar in its portfolio?
We now turn to Booking Holdings. Booking.com is its Dutch daughter company. Several NGOs have launched a court case against Booking.com for laundering profits from Israeli war crimes in Palestine. The company facilitates the rental of holiday homes built on land stolen from the Palestinian population. Booking is listed in the updated UN Database as one of the companies "providing services and utilities supporting the maintenance and existence of settlements".
Amnesty International concludes that by boosting the settlement tourism industry and, as a result, the settlement economy, Booking.com is contributing to, and profiting from, the maintenance, development and expansion of illegal settlements.
And then there is Cisco Systems. In 2018, Cisco established a long-term partnership with the Israeli government on a large-scale project that is partially implemented in occupied Palestinian and Syrian lands.
Finally, we turn to Motorola. Motorola Solutions cooperates with the Israeli army, the Ministry of Defence and with settlement councils throughout the Occupied Palestinian Territory. Motorola is among the business enterprises included in the updated UN Database (June 2023), due to the supply of surveillance and identification equipment for settlements, the Separation Wall and checkpoints directly linked with settlements; as well as the supply of security services, equipment and materials to enterprises operating in settlements.
Other pension funds in Europe are divesting from the occupation. As well as the Norwegian funds' various divestments, the Universities Superannuation Scheme (USS) in the UK has ‘materially’ reduced exposure to Israeli stocks and debt following pressure from members. We note that ABP has already divested from two Israeli banks, but we urge you to go further, in line with your Sustainable and Responsible Investment policy, and to divest from all investments which are contributing to Israel's illegal occupation and serious human rights violations.
If you have in fact now divested from the companies named above, we will be very glad to hear this, and we look forward to seeing announcements of your decision on your website and in press releases.
